ICE and the I-9

For business owners: I am hearing rumblings that ICE is going to be doing more I-9 compliance checks.

  • The I-9 is an employment form that gives the information necessary to prove an employee can work within the US legally.

  • Two forms of identification are required. There’s a list of acceptable documents on the form & instructions.

  • This form should be collected as part of the employment process from every employee, regardless of status (part-time, salaried, hourly, etc.)

  • Do keep in mind that I am NOT a labor attorney or an HR specialist. I’m just passing on what I’ve heard in the various business publications that I read.

  • Fines and penalties can range from a few hundred dollars to tens of thousands depending on knowledge, intent and number of workers.
